I AGREE TO RELEASE, DISCHARGE, HOLD HARMLESS and INDEMNIFY The Range at Ballantyne, Inc. (“The Range”) and their officers, directors, shareholders, members, representatives, agents, landlords, guests, sponsors, employees, interns or any person or entity which may be held liable in their place on behalf of myself, my heirs, assigns, attorneys in fact, personal representatives, or any other representative or successor in interest and estate in exchange for right to enter The Range property and engage in the activities described below as follows:

Assumption of Risk

I understand and acknowledge that the training, testing, shooting and any other related activity in which I engage as a participant at The Range or any other venue used for the purpose of The Range (hereinafter “Activity”) bears certain risks inherent in handling, shooting or discharging firearms or use of products or equipment associated with such activities which could result in serious injury, death, illness or disease, physical or mental, or damage to myself, my or others’ property, or to spectators or other third parties.

Being aware that the Activity entails known and unknown risks of injury or illness to myself and a risk of injury or illness to spectators or other parties as a result of my actions and/or participation, I EXPRESSLY AGREE, COVENANT, AND PROMISE TO ACCEPT AND ASSUME ALL RESPONSIBILITY AND RISKS FOR INJURY, DEATH, ILLNESS, OR ILLNESS, OR DAMAGE TO MYSELF, TO OTHERS OR TO PERSONAL PROPERTY OF MINE OR OTHERS ARISING FROM MY PARTICIPATION IN ANY ACTIVITY associated with The Range.

I acknowledge that my participation in this Activity is purely voluntarily. No one is forcing me to participate and I elect to participate in spite of the risks, both known and unknown. I further acknowledge that shooting or remaining present are each inherently dangerous activities and that the weapons that I or others use can kill, maim, damage and injure humans, wildlife, and property. I also understand that The Range makes no express or implied representation as to the condition of any roads, buildings, facilities or other improvements on The Range property or on which the Activity will take place. I EXPRESSLY ACKNOWLEDGE THE EXISTENCE OF ALL SUCH RISKS, HAZARDS AND DANGERS TO WHICH I MAY BE EXPOSED ON THE RANGE PROPERTY and assume any risk which may arise from, by or through them.

Waiver and Release

I voluntarily waive, release and forever discharge The Range, their officers, directors, shareholders, members representatives, agents, guests, sponsors and employees, on behalf of myself, my heirs, assigns, attorneys in fact, personal representatives, successors in interest and estate from any and all liability, claims, demands, actions, which are related to, arise out of, or in any way connect with my participation in the Activities, including specifically, but not limited to the ordinary or grossly negligent acts or omissions of The Range, their officers, directors, shareholders, members, representatives, agents, guests, sponsors and employees, and all other persons or entities for any and all injury, death, illness or disease and danger to my person or property. IN SIGNING THIS DOCUMENT, I EXPRESSLY ACKNOWLEDGE THAT I AM RELEASING THE RANGE AND THEIR OFFICERS, DIRECTORS, SHAREHOLDERS, MEMBERS, AGENTS, SPONSORS, REPRESENTATIVES, GUESTS, EMPLOYEES AND ANY OTHER PERSON OR ENTITY WHICH MAY BE HELD LIABLE IN THEIR PLACE FROM LIABILITY FOR DAMAGES CAUSED BY THE GROSS OR ORDINARY NEGLIGENCE OF THE RANGE AND THEIR OFFICERS, DIRECTORS, SHAREHOLDERS, MEMBERS, AGENTS, SPONSORS, REPRESENTATIVES, GUESTS, AND EMPLOYEES.

Rules of The Range

I acknowledge that The Range has rules governing the use of their facilities for Activities and that I have been provided a list of those rules. I further agree to be bound by those rules and the direction of staff members of The Range while there.

I certify that I have sufficient health, accident, and liability insurance to cover any bodily injury or property damage I may incur while participating in this event and to cover bodily injury or property damage caused to any third party (including, but not limited to, The Range and/or its staff specifically) as a result of my participation in the activities described above. If I do not have sufficient insurance as stated above, I certify that I am capable of paying personally for any and all such expenses or liability and agree to be so responsible to any party against whom I may inflict damages of any type.

Indemnification and Hold Harmless

I agree to hold harmless and indemnify (and covenant and agree not to sue or not to enforce any judgment against) The Range against any and all losses they may sustain as a result of any action, inaction, damage, claim or cause of action, including reasonable attorney’s fees, asserted by any party or caused or incurred by my presence or participation in any Activity conducted by or on behalf of The Range. I understand that by indemnifying The Range, should it become necessary for The Range, or someone on their behalf, to incur attorneys’ fees and costs to enforce this Agreement, or any portion thereof, I agree to pay any reasonable costs and attorneys’ fees arising therefrom.

This release, discharge, and indemnification voluntarily given by me herein shall extend to, and be for the benefit of, any person, corporation, partnership, or other entity affiliated with The Range, their operations, or the property with which The Range may be affiliated in connection with their operations in any capacity, including but not limited to as a partner, limited partner, shareholder, or otherwise.

If any provision of this Participant Release and Indemnification Agreement is or may be held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions shall nevertheless survive and continue in full force and effect without being impaired or invalidated in any way. This Release and Indemnification Agreement is governed by the laws of the state of South Carolina and the proper venue of any action arising from or defended by this Agreement shall be Lancaster County, South Carolina.

MY SIGNATURE BELOW INDICATES THAT I HAVE READ THIS ENTIRE DOCUMENT, UNDERSTAND IT COMPLETELY, UNDERSTAND THAT IT AFFECTS MY LEGAL RIGHTS, AND AGREE TO BE BOUND BY ALL OF ITS TERMS.
